The terms and conditions outlined here shall form the complete agreement under which you, as a seller, will do business with us Auction Solution Services Limited. In order to constitute any changes to these terms and conditions, Auction Solution Services shall reserve the right to update these terms and conditions by publishing new terms and conditions on our website at http://www.auction-solution-services.co.uk. Any new terms and conditions so published shall supersede these from their time of publication.

The terms and conditions outlined here shall be governed by the laws of England and Wales. Any dispute shall be subject to the jurisdiction of English Courts.

2. Our Offered Services to you.

Auction Solution Services Limited shall position itself strongly in the competitive online market by enhancing the core proposition of its competitors through a series of uniquely differentiating features to offer you the seller (Our Client) a range of diversified services tailored to your requirements making the entire process user friendly, hassle free and above all else ensuring maximum return on the items you submit for auction/sale.

a) Drop-Off & Auction/Sale

Our drop-off service enables you the seller (Our Client) the opportunity to deliver your item(s) to us for auction/sale

b) Collection & Auction/Sale

Our collection & auction/sale service enables you the seller (Our Client) the opportunity to authorise us to collect your item(s) return them to our premises and manage the entire process end-to-end.

c) Retained Item(s) – Client – Auction/Sale

Our Retained Item(s) service enables you the seller (Our Client) the opportunity to retain the item(s) on your premises where-by upon completion of sale/auction the buyer either collect from you the seller (Our Client) or alternatively you can arrange shipment to the buyer yourself. This service level is primarily used for the auction/sale of large bulky items. The option exists for the seller (Our Client) to supply descriptions and digital images to us ready for upload into one of our auction/sales listings.

Descriptions and Images supplied to Auction Solution Services Limited by the seller (Our Client) shall need to be accurate and not misleading in any way. These shall include product details, model numbers etc (if applicable) and any known defects clearly identified. Auction Solution Services Limited shall not be held responsible for any misinterpretation of description supplied by the seller (Our Client) and subsequently used on an auction/Buy It Now listing.

Alternatively, Auction Solution Services Limited can (by appointment) visit you premises to record description(s) (item details) and take comprehensive digital images, which in turn, shall be uploaded into our auction/sales listings.

d) Logistics Only Service

This service offers our clients and other eBay sellers the opportunity to offer a complete and flexible end solution to the sale of their items with regards collection and delivery of items known to be large or bulky (normally in excess of 30kg). This service level operates with long wheelbase, high top, Ford Transit vans specializing in light haulage, commercial and domestic items.This service covers both local and national destinations throughout mainland UK

Our auctions, sales (Item(s) and / or services submitted for sale via our eBay shop) shall be run in accordance with the rules and regulations currently in force on eBay. Auction listings shall be undertaken for a duration of between 3 & 10 days. Buy It Now formats shall be listed for periods between 7,10.30 & 90 days.

It shall be entirely at our discretion how to list the items in the auction, including, but not limited to, collecting items together to form larger lots or splitting out groups of items. We shall set reserves or minimum bids where we choose, except when a specific reserve or starting price has been agreed on the lot registration form and paid for by you the seller (Our Client). The final price shall in all cases be determined by the highest bid, which we reasonably accept, (and is not under our control) unless the listing contains a “Buy It Now” option in which case the final price shall be set as the Buy It Now price.

The client should note that the final prices for identical lots might vary according to bidder demand. Upon receipt of payment from the buyer, you (The Client) shall pass title of ownership directly of the item(s) to the buyer. Auction Solution Services shall not take ownership of any item(s) as part of this process. Current eBay rules allow the buyer a 7-day return window during which time they may reverse this transaction. If the buyer does reverse this transaction, we may offer the lot to other bidders, possibly at a lower price, or re-list the item for re-auction/sale. Subsequent re-listings shall be subject to an additional fee (see Section 4)

5. Your obligations.

When consigning the item(s) or services any of your items for sale under service levels (a), (b) & (c) above, you the seller (Our Client) warrant that they are your own property, the item(s) or services may legally be offered for sale and that you are not constrained from selling them in any way. You shall include in the item description all material information, including any defects known to you and warrant that this description is not misleading in any way. You the seller (Our Client) shall not offer for sale any items prohibited by eBay in their rules. You the seller (Our Client) shall not do or say anything, which shall interfere with the proper and fair progress of the auction/sale once underway. The seller (Our Client) shall indemnify Auction Solution Services Limited for any loss or damage due to inaccuracies in your description, or any actions you may take which affect the auction. Furthermore, Auction Solution Services Limited reserve the right to withdraw any item(s) or services from sale without reference to the seller (Our client) in the event of a breach of these obligations and seek payment of reasonable costs incurred.

6. Your personal information

Auction Solution Services Ltd shall hold your personal information electronically. We shall use this information to deal with you the seller (Our Client) in setting up your account and in the normal course of doing business with you. Auction Solution Services Limited may from time to time wish to contact you with information and offers. We will ask you to opt-in to this when you sign up, and you may opt-out of this at any time. Auction Solution Services Limited shall never sell your information to a third party, and will only disclose it where we are obliged to in order to resolve a dispute or are compelled to by law.

Auction Solution Services Limited shall not be liable for any loss or damage - direct, consequential or loss of profit, that you the seller, (Our Client), may suffer as a result of this agreement.

In particular Auction Solution Services Limited shall make no representation about the selling price of your items. In all cases - except where provided otherwise by statute - our absolute liability shall be limited to the selling price of your items, or agreed start price if unsold.
